SpiceJet on Friday moved a division bench of the Delhi high court seeking damages from Sun Group chairman Kalanithi Maran alleging a breach of contract by the latter. It also sought to overturn a single bench order in July that upheld the validity of an arbitration award in favour of the Marans. The single bench is hearing the execution of the arbitral award and is yet to decide on the payment schedule by the airline to Maran. In earlier proceedings, Maran had claimed SpiceJet had forfeited its right to be heard in court by wilfully disobeying orders. In response, SpiceJet argued that demanding immediate payment could push the airline into insolvency, which would not benefit the Marans, as they would become operational creditors.

In the 21 years since it flew in its first avatar, ModiLuft, four sets of promoters have brought in fresh capital and new ideas- each trying and make a success of it. The biggest of the bets was taken in June , when Kalanithi Maran, chairman and managing director of the Sun Group, paid Rs crore to buy a 38 percent stake in SpiceJet from American private equity investor Wilbur Ross and the UK-based Kansagra family. Over the last few years, he invested another Rs crore, increasing his share in the company to 53 percent. Using his network in the financial world, Singh was able to bring in successive rounds of funding between and when Maran came in. Ross bought out Ajay Singh and, partly, the Kansagras, and exited at a profit in When he bought into it, India was already littered with examples of airlines that were either dead or dying Kingfisher had begun drowning in debt; Air Deccan, MDLR and Paramount had faltered too. Members of the staff who were present in the office just after his company Kal Airways, that part of the Sun Group that manages the airline business, took over in , say he was brimming with confidence.
