I worded it differently, several times, and that is the answer I was given. It was a software, reporting issue. I swapped the charging cases to see if there was a charger issue, rather than just the buds themselves. So about 1 hour of use to get to that. So, the firmware and ability is "a wolf in sheep's clothing"; or a trojan horse. I have this problem as well.
